Terms of Service

1. Eligibility

Participants must be 18 years of age or older to register and be eligible for prizes. Those under 18 may participate only with the express consent and supervision of a parent or legal guardian. The Hunt is designed for residents and visitors of Montgomery County, Texas.

2. Registration & Accounts

You must provide accurate and complete information during registration, including your name, email address, and phone number. Only one registration per person is permitted unless otherwise approved by the Organizer. You are responsible for maintaining the accuracy of your registration information and for all activity associated with your registration.

3. SMS Communications & Consent

By providing your phone number and checking the applicable consent box during registration, you agree to receive SMS text messages from Montgomery Mystery Hunt related to your account, Hunt participation, clues, updates, event notifications, prize notifications, and related services.

Message frequency may vary. Message and data rates may apply depending on your mobile carrier plan. Consent to receive SMS messages is not required as a condition of purchase.

You may opt out at any time by replying STOP to any SMS message. For help, reply HELP or contact us directly at [email protected].

4. Marketing & Promotional Messages

If you separately opt in to receive marketing and promotional SMS messages, you may receive sponsor updates, promotional offers, event announcements, and other Hunt-related promotional messages from Montgomery Mystery Hunt.

You may opt out of promotional SMS messages at any time by replying STOP. Opting out of promotional messages may limit your ability to receive certain optional sponsor offers but will not prevent you from participating in the Hunt unless SMS delivery is required for a specific game feature.

6. Game of Skill

The Montgomery Mystery Hunt is intended to be a game of skill, logic, observation, and clue-solving. Winners are determined by successful completion of Hunt requirements and prize verification, not by random drawing or chance.

7. Code of Conduct

Participants must act safely, respectfully, and legally at all times. The following behaviors may result in immediate disqualification without refund:

• Trespassing on private property or entering restricted areas.
• Damaging, moving, digging, or tampering with public or private property.
• Harassing, stalking, intimidating, or following other participants, sponsors, staff, or members of the public.
• Disrupting sponsor locations or normal business operations.
• Searching while under the influence of drugs or alcohol.
• Engaging in reckless, unsafe, illegal, or disorderly conduct.
• Attempting to hack, exploit, reverse engineer, or interfere with the website, SMS system, email system, social media, clues, or game operations.

Participants must follow all applicable laws, posted rules, park rules, business rules, and instructions from law enforcement, property owners, or authorized personnel.

8. Location Rules

Hunt activity may occur in public areas of Montgomery County, Texas and may reference local businesses or sponsors. Participants must not enter private property, restricted areas, dangerous locations, or any area where access is prohibited.

Clues are not permission to trespass, damage property, disturb wildlife, interfere with traffic, or violate any law or posted rule.

9. Prizes & Verification

The first eligible participant to successfully complete the Hunt requirements, locate the required token or complete the required verification process, and satisfy all rules may be declared the winner, subject to Organizer verification.

The Organizer reserves the sole right to verify eligibility, completion steps, prize claims, and compliance with the Official Rules and these Terms. Winners are responsible for all applicable taxes, reporting obligations, and any expenses not expressly included with the prize.

10. Sponsor Offers & Third-Party Prizes

Some prizes, discounts, perks, or promotional offers may be provided by sponsors or participating businesses. Sponsors are solely responsible for honoring their own offers, prize terms, redemption requirements, availability, expiration dates, and fulfillment obligations.

Montgomery Mystery Hunt and Pencil and Stone Marketing are not responsible for sponsor availability, sponsor fulfillment, sponsor business operations, or changes to sponsor offers unless expressly agreed in writing.

11. Media, Photos & Likeness

By participating in the Hunt or attending related events, you understand that photos, videos, or other media may be captured and used by Montgomery Mystery Hunt for promotional, marketing, social media, or recap purposes, unless prohibited by law.

12. Limitation of Liability

Participation in the Hunt is entirely at your own risk. Pencil and Stone Marketing, Montgomery Mystery Hunt, sponsors, partners, affiliates, and representatives are not liable for injuries, accidents, property damage, lost property, business interruption, rescue costs, emergency services, or other losses arising from participation.

By participating, you agree to release and hold harmless the Organizer and sponsors from claims related to your participation to the fullest extent permitted by law.

13. No Guarantee of Availability

We attempt to keep the website, SMS system, email system, and related services available, but we do not guarantee uninterrupted or error-free operation. Technical issues, carrier delays, system outages, weather, public safety concerns, or other circumstances may affect timing, delivery, or availability. Mobile carriers are not liable for delayed or undelivered messages.

14. Modifications to the Hunt

Organizers reserve the right to modify, delay, suspend, cancel, or adjust the rules, prizes, clues, timing, locations, or structure of the Hunt at any time to preserve fairness, legal compliance, safety, sponsor obligations, or game integrity.

Continued participation after changes are posted or communicated constitutes acceptance of the updated terms.

15. Privacy Policy

Your use of the website and participation in the Hunt are also governed by our Privacy Policy, available at https://montgomerymysteryhunt.com/privacy-policy.

SMS opt-in data and consent information will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

16. Governing Law

These Terms are governed by the laws of the State of Texas. Venue for any dispute shall lie exclusively in Montgomery County, Texas, unless otherwise required by applicable law.
